Terms of Use

These Terms of Use (“Terms”) govern your access to and use of MyExpertPros.com, MyExpertPros mobile applications, directory services, business software, communications tools, payment-related features, and related products and services (collectively, the “Services”).

MyExpertPros is a registered fictitious name/DBA of Design Develop Now, Inc., a Florida corporation. In these Terms, “MyExpertPros,” “we,” “us,” and “our” refer to the operator of the Services.

By accessing or using the Services, creating an account, purchasing a subscription, claiming a listing, requesting a quote, or otherwise indicating acceptance of these Terms, you agree to be bound by them. If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

1. Who May Use the Services

You must be legally capable of entering into a binding agreement to create a professional account, purchase a subscription, accept customer payments, or enter into a service transaction through MyExpertPros. Business and transaction accounts are intended for users who are at least 18 years old or the age of legal majority where they live.

You may not use the Services if you are prohibited from doing so by applicable law.

2. What MyExpertPros Provides

MyExpertPros provides a platform that may include:

a directory of local service professionals;
claimed and unclaimed business listings;
quote-request and customer-lead routing;
reviews and business responses;
scheduling and booking tools;
customer and job management;
estimates and invoices;
messaging and SMS functionality;
payment and payment-tracking integrations;
business analytics and reporting; and
subscription-based directory and software features.

Features may be added, changed, limited, suspended, or discontinued from time to time.

3. MyExpertPros Is a Platform, Not the Service Provider

Unless expressly stated otherwise, MyExpertPros does not itself perform plumbing, HVAC, electrical, painting, landscaping, cleaning, repair, construction, or other home or professional services listed through the platform.

Consumers and service professionals are responsible for deciding whether to enter into a service relationship and for agreeing on the scope, price, timing, warranty, licensing, insurance, permits, and other terms of the work.

MyExpertPros is not an employer, contractor, subcontractor, agent, partner, or joint venturer of a listed service professional merely because that professional appears in the directory or uses the Services.

4. Listings, License Information, and “Certified Partner” Status

MyExpertPros may publish information obtained from public records, government licensing databases, business websites, public directories, or other lawful sources. Public-record and third-party information may be incomplete, delayed, or inaccurate.

A listing marked “Unclaimed” has not necessarily been created or approved by the listed business. The business may claim the listing and request corrections.

MyExpertPros may display license information or a license-verification status based on information available from licensing authorities or other sources. You should independently confirm that a professional has the licenses, permits, insurance, experience, and qualifications required for your particular project.

The Certified Partner designation identifies a MyExpertPros membership level and any eligibility or verification criteria expressly described by MyExpertPros. It does not constitute a guarantee, warranty, endorsement, background check, insurance certification, or promise regarding a professional’s workmanship, reliability, safety, pricing, suitability, or future performance.

5. Accounts and Organization Access

You are responsible for providing accurate account information and keeping it current. You are also responsible for safeguarding login credentials and for activity conducted through your account, except to the extent caused by our own failure to use reasonable security measures.

Business-account owners or administrators may invite team members and assign access to organizational data. The business is responsible for managing authorized users and promptly removing access that is no longer appropriate.

You may not share credentials in a manner that defeats account or security controls.

6. Consumer Requests and Professional Responses

When a consumer submits a quote request, booking request, or other service inquiry, MyExpertPros may transmit the request to one or more potentially relevant service professionals.

Submission of a request does not guarantee that a professional will respond, accept the project, provide a particular price, or be available at a requested time.

Professionals are responsible for the accuracy of quotes, estimates, availability, service descriptions, licenses, representations, and communications they provide.

7. Reviews and User Content

You may be able to submit reviews, ratings, photos, business responses, profile information, messages, project descriptions, and other content (“User Content”). You retain ownership of User Content you create, subject to the license below.

You grant MyExpertPros a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, distribute, and otherwise use your User Content as reasonably necessary to operate, secure, promote, and improve the Services and to display the content in the locations you chose to make it available.

You represent that you have the rights necessary to submit your User Content and that it does not violate law, privacy rights, intellectual-property rights, or these Terms.

A label such as “verified review” or “verified transaction” means only that MyExpertPros has applied the verification method described by the platform, such as associating the review with a documented interaction or transaction. It is not a guarantee that every statement in the review is accurate.

We may moderate, remove, restrict, or refuse content that violates our policies or creates legal, safety, fraud, or platform-integrity concerns. We do not guarantee that every objectionable item will be identified or removed.

8. Prohibited Conduct

You may not use the Services to:

violate applicable law or another person’s rights;
impersonate another person or business or misrepresent your affiliation, license status, credentials, insurance, or qualifications;
submit fraudulent, deceptive, defamatory, harassing, threatening, discriminatory, obscene, or unlawful content;
create fake reviews, manipulate ratings, pay for undisclosed reviews, or review your own business through a false identity;
scrape, harvest, copy, or systematically extract directory data except as expressly permitted by us;
send spam, unlawful marketing, or communications to recipients who have not provided required consent;
upload malware, interfere with security controls, probe vulnerabilities, or disrupt the Services;
reverse engineer the Services except where applicable law expressly permits it;
use the Services to build or train a competing directory or commercial database through unauthorized copying of MyExpertPros content; or
use the Services in a way that could expose MyExpertPros or others to legal, regulatory, security, or reputational harm.

9. Business Software and Customer Data

A professional or business that enters customer, employee, technician, subcontractor, job, scheduling, invoice, message, or other information into the Services is responsible for having the legal right to do so.

Businesses are responsible for providing any required privacy notices and obtaining any required consents from their customers and contacts. This includes consent required for text messaging, marketing communications, and any sensitive information a business chooses to collect.

You should not use MyExpertPros to store Social Security numbers, full payment-card information, health records, passwords belonging to third-party services, or other highly sensitive data unless a feature expressly requests that information and is designed to handle it.

10. Messaging and SMS Terms

MyExpertPros may offer SMS messaging for account notices, authentication or security, quote requests, job or booking updates, customer-professional communications, reminders, and other service-related messages. Promotional SMS messages will be sent only where permitted and where any required marketing consent has been obtained.

By affirmatively opting in to a MyExpertPros SMS program, you agree to receive the categories of text messages described at the point of consent at the mobile number you provide. Message frequency may vary. Message and data rates may apply. Consent to promotional text messages is not a condition of purchasing goods or services.

Reply STOP to opt out of the applicable SMS program. Reply HELP for help, or email info@myexpertpros.com. Carriers are not liable for delayed or undelivered messages.

MyExpertPros does not sell or share mobile information, text-message opt-in data, or SMS consent with third parties or affiliates for their own marketing or promotional purposes. Information may be provided to telecommunications carriers, Telnyx, platform providers, and other vendors solely as necessary to operate or support the messaging service.

Professional Use of SMS

If you use MyExpertPros to send text messages to your own customers or contacts, you are the sender responsible for your messaging program and you agree that you will:

message only recipients for whom you have the consent required by applicable law and carrier rules;
maintain evidence of consent where required;
clearly identify your business in messages when appropriate;
honor STOP and other recognized opt-out requests;
provide HELP information when required;
not purchase, rent, borrow, scrape, or otherwise use third-party phone-number lists for unsolicited messaging;
not use consent collected for one purpose as permission for unrelated marketing; and
comply with applicable telecommunications laws, carrier requirements, and MyExpertPros or Telnyx messaging policies.

We may filter, block, limit, suspend, or terminate messaging activity that creates legal, carrier, deliverability, spam, fraud, or abuse concerns.

11. Subscriptions, Trials, Billing, and Renewal

Paid features may be offered as recurring subscriptions. The price, billing interval, included features, trial terms, taxes, and any applicable fees will be disclosed at or before purchase.

Unless otherwise stated at checkout, a recurring subscription renews automatically for successive billing periods until canceled. You authorize the applicable payment provider to charge the payment method associated with your account for recurring fees, taxes, and authorized charges.

If a trial is offered without requiring a payment method, you will not be charged merely because the trial ends. Continued access to paid features after the trial will require you to affirmatively subscribe or provide any required payment authorization.

You may cancel a web-billed subscription through the account or billing settings made available by MyExpertPros. Unless otherwise stated, cancellation takes effect at the end of the then-current paid billing period and does not retroactively refund prior charges.

Fees are nonrefundable except where required by law or where MyExpertPros expressly states otherwise. We may change prices prospectively and will provide notice where required.

App Store and Google Play Billing

If a subscription or other purchase is offered and purchased through the Apple App Store or Google Play, the applicable store’s billing, cancellation, and refund rules apply to that purchase. You are responsible for managing the store subscription through your Apple or Google account when required.

Deleting a MyExpertPros account does not necessarily cancel an Apple App Store or Google Play subscription. Cancel the store subscription separately when applicable.

12. Payments Between Professionals and Customers

Payment functionality may be provided through Stripe, Stripe Connect, or another payment provider. Use of payment features may require acceptance of additional payment-provider terms and completion of identity or business verification.

Professionals are responsible for the goods and services they sell, their invoices, taxes, refunds, warranties, disputes, and compliance with applicable law. Payment providers may delay, withhold, reverse, or restrict funds as permitted by their terms or applicable law.

MyExpertPros may charge platform, subscription, payment, or other fees disclosed before the relevant transaction or service.

13. Intellectual Property

The Services, excluding User Content and third-party content, including the MyExpertPros name, software, interface, design, graphics, databases, compilation, and other materials, are owned by or licensed to MyExpertPros and are protected by applicable intellectual-property laws.

These Terms do not grant you ownership of the Services or permission to use MyExpertPros trademarks except as expressly authorized.

14. Feedback

If you provide ideas, suggestions, or feedback about the Services, you grant us the right to use that feedback without restriction or compensation, provided we do not publicly identify you as the source without permission.

15. Third-Party Services

The Services may integrate with or link to third-party services such as payment processors, maps, business websites, analytics providers, telecommunications providers, authentication providers, and app stores. Third-party services are governed by their own terms and policies.

MyExpertPros is not responsible for a third party’s independent products, services, availability, or conduct.

16. Mobile Applications

Subject to these Terms and any applicable app-store license terms, MyExpertPros grants you a limited, non-exclusive, non-transferable, revocable license to install and use the mobile application on devices you own or control for your personal or internal business use.

You must comply with applicable third-party terms, including your wireless-data and app-store agreements.

Apple App Store Users

If you download the MyExpertPros application through Apple’s App Store and MyExpertPros does not provide a separate custom end-user license agreement through App Store Connect, Apple’s then-current Standard Licensed Application End User License Agreement applies to the license for the iOS application. These Terms continue to govern your MyExpertPros account, subscriptions, platform activity, and use of the Services to the extent they do not conflict with Apple’s applicable license terms.

Apple is not responsible for providing maintenance or support for MyExpertPros, except as required by applicable law or Apple’s own terms. Questions regarding the Services should be directed to MyExpertPros at info@myexpertpros.com.

Google Play Users

If you download the MyExpertPros application through Google Play, your use of Google Play is also subject to Google’s applicable terms and policies. These Terms govern your relationship with MyExpertPros regarding the Services.

17. Suspension and Termination

You may stop using the Services at any time. You may request account deletion as described in our Privacy Policy.

We may suspend, restrict, or terminate access if we reasonably believe you have violated these Terms, created fraud, security, legal, carrier, payment, or safety risk, failed to pay amounts due, abused the Services, or if suspension is necessary to protect the platform or other users.

Where reasonable under the circumstances, we may provide notice or an opportunity to address the issue before termination.

18. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

MYEXPERTPROS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT DIRECTORY INFORMATION, LICENSE INFORMATION, REVIEWS, QUOTES, AVAILABILITY, OR OTHER THIRD-PARTY OR USER-PROVIDED INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR ACCURATE.

MYEXPERTPROS DOES NOT GUARANTEE THE QUALITY, SAFETY, LEGALITY, PRICING, LICENSING, INSURANCE, SUITABILITY, OR PERFORMANCE OF ANY SERVICE PROFESSIONAL, CUSTOMER, OR PROJECT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYEXPERTPROS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL ARISING OUT OF OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO MYEXPERTPROS FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

20. Indemnification by Business Users

To the extent permitted by law, if you use the Services on behalf of a business or as a service professional, you agree to defend, indemnify, and hold harmless MyExpertPros and its officers, directors, employees, and agents from third-party claims, damages, liabilities, losses, and reasonable costs arising from your services, your User Content, your customer communications, your violation of law, or your breach of these Terms.

This section does not require a consumer to indemnify MyExpertPros where such an obligation is prohibited by applicable law.

21. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects legal rights.

Before filing a formal claim, you and MyExpertPros agree to try in good faith to resolve the dispute informally for at least 30 days. A notice of dispute should describe the issue and requested relief and be sent to info@myexpertpros.com with the subject line Legal Dispute Notice.

Except for an eligible claim brought in small-claims court, a claim for injunctive relief concerning unauthorized use of intellectual property, or a claim that applicable law does not allow to be arbitrated, disputes arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under the rules applicable to the dispute.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.

Arbitration will take place only on an individual basis. To the maximum extent permitted by law, neither party may bring or participate in a class, collective, consolidated, or representative action or arbitration.

You may opt out of this arbitration provision by emailing info@myexpertpros.com within 30 days after first accepting these Terms. Your email must include your name, the email address associated with your MyExpertPros account, and a clear statement that you are opting out of arbitration. Opting out of arbitration does not affect the other provisions of these Terms.

If applicable law gives you a non-waivable right to bring a particular claim in court or prohibits enforcement of part of this section, that law controls to the extent of the conflict.

22. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration provision above.

For disputes that are not subject to arbitration and may lawfully be brought in court, the parties consent to the jurisdiction of the state and federal courts located in Florida, subject to any non-waivable venue rights provided by applicable law.

23. Changes to the Services or Terms

We may update these Terms from time to time. If a change is material, we will provide notice as required by law. The updated Terms become effective on the date stated at the top unless a different date is specified.

Your continued use of the Services after updated Terms become effective constitutes acceptance where permitted by law.

24. General Terms

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, except where applicable law provides otherwise. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.

These Terms, together with our Privacy Policy and any additional terms presented for a specific feature, form the agreement between you and MyExpertPros regarding the Services.
